Kingse Safaris Terms & Conditions

The Terms & Conditions outlined below apply specifically to the services provided by Kingse Safaris (hereinafter
referred to as “Kingse Safaris,” “we,” “us,” and “our”) to you, our client (hereinafter referred to as “client,”
“traveller,” “you,” the lead booker, and the booking party). These terms also govern the use of our
website, social media pages and online portals. They supersede any conflicting
terms and conditions from external entities.

Privacy and Data Protection

At Kingse Safaris, we are dedicated to safeguarding your privacy and managing your personal data in line with
our privacy policy. By using our website and reaching out to us through the provided channels, you consent to
the collection, use, and disclosure of your personal information as outlined in our privacy policy.

Modification of Our Terms & Conditions

Kingse Safaris reserves the right to modify and/or update our terms and conditions at any time. Any changes
will take effect immediately upon being posted on our website. By continuing to use our website after such
updates, you agree to be bound by the new terms. Clients who have already made a booking will receive an
email notification regarding any revisions to our terms and conditions. The updated terms will automatically
apply from that point forward, unless the client submits a written objection within two weeks.

Intellectual Property

The content, logos, trademarks, and other intellectual property featured on our website are owned by or
licensed to Kingse Safaris and are safeguarded by relevant intellectual property laws. Unauthorized use,
reproduction, modification, distribution, or display of any of our intellectual property is prohibited without
prior written consent from us.

Bookings and cancellation T&C’s

Booking Confirmation

Once a client requests a quote via our website, we will promptly send a detailed itinerary to their email. This
itinerary will provide insights into the various destinations, activities, and accommodations involved in their
safari, allowing for a full understanding of the experience. It is essential for the client to confirm their
acceptance of this itinerary or suggest any desired modifications.

The safari services agreed upon will be provided as outlined, except in cases of unforeseen circumstances such
as road closures, adverse weather, or security issues. In such situations, modifications or cancellation of the
itinerary may occur (see sections 5.3.2 and 6.2).

Payment

Clients can make payments through bank transfers, debit or credit cards, or direct card payments.

Upon acceptance of the proposal, clients will receive an invoice containing all necessary details. A deposit of
50% of the itinerary cost is required within 10 days of receiving the invoice. If the booking is made within 61
days of departure, full payment is required at the time of booking. Delays in payment may result in the inability
to guarantee the reservation.

For international airline tickets booked through us, full payment must be made by a specified deadline.

In either case, total payment is due no later than 61 days prior to the departure date. Failure to complete
payment by this deadline grants us the right to cancel the booking and apply the applicable cancellation fees
(refer to section 5.3.1). The travel agreement will automatically be nullified, and clients will be notified
accordingly. In such instances, we assume no liability, and cancellation incurs no penalties on our part. The lead
booker is responsible for ensuring full payment is made on behalf of all participants.

Cancellation by the Client

Should you decide to cancel your booking, either fully or partially, Kingse Safaris will apply cancellation charges
as detailed below. Cancellation fees will not apply if the traveller decides to terminate the contract due to an
unacceptable proposal for a substantial modification of the trip. Additionally, if unavoidable and unforeseen
circumstances arise at the destination that significantly hinder the execution of the trip, cancellation fees will
also be waived at Kingse Safaris’ discretion.

More than 61 days before departure: Non-refundable deposit

0-61 days before departure: 100% of the total itinerary cost minus admin fees and nonrefundable deposits as
accommodation providers differ on their policies, please note we will try our best to secure the most refund
possible.

For trips to Africa, the terms and conditions set forth by our vehicle rental provider will also be applicable.
Please note that all stipulations in that document relate solely to the rental vehicle and do not pertain to
the trip itself.

Cancellation by Kingse Safaris

While we strive to avoid cancellations, Kingse Safaris reserves the right to cancel your holiday for the reasons
and deadlines specified below.

Reasons for Cancellation:

-Failure to pay the travel sum as required.
-Legitimate concern that you will not pay the travel sum in full before it becomes due.
-Insufficient minimum number of participants on the specified date

Deadlines for Cancellation:

– For trips exceeding 6 days: cancellation must occur at least 20 days before departure.
– For trips lasting 2 to 6 days: cancellation must occur at least 7 days before departure.
– For trips under 2 days: cancellation must occur at least 48 hours before departure.

For last-minute trips (within 61 days of booking), the full travel price must be paid within two days of the
invoice being issued, regardless of the standard 10-day timeline noted on the invoice. Failure to comply will put
you in legal default, allowing Kingse Safaris to terminate the contract immediately.

Additionally, we reserve the right to cancel your holiday during your trip if you fail to adhere to local laws, or
regulations set forth by tours, carriers, and accommodations. We cannot be held liable for any failure or delay
in fulfilling our contractual obligations due to your non-compliance with applicable laws or regulations. If your
behavior poses a risk, distress, or significant annoyance to others, Kingse Safaris may terminate your travel
arrangements without liability, and you will not be entitled to any refund for unused or missed services or
costs resulting from the termination.

Kingse Safaris cannot accept liability for any failure to perform our contractual obligations, or any damage or
loss you may suffer, due to circumstances classified as force majeure (see section 15.1). In such cases, we
cannot provide a refund. However, if we are able to recover any funds from our service providers, we will pass
those refunds on to you. Please note, you will not be entitled to any additional compensation.

We also reserve the right to cancel your confirmed holiday if you fail to comply with any of the booking
conditions that allow us to do so.

Changes to Your Holiday

While changes to your holiday are unlikely, Kingse Safaris reserves the right to make changes at any time. Most
alterations are minor, and we will notify you in writing as soon as possible. In the case of a major change—such
as significant alterations to flights, accommodations, or activities (unless due to force majeure or airline
schedule changes)—we will make reasonable efforts to maintain the same quality and comparable experience
of your itinerary. If substantial changes reduce the quality or value of travel services, we will provide you with a
reasonable time to accept the change, select another holiday, request a price reduction, or terminate the
package tour agreement for a full refund. No additional compensation will be provided.

We cannot accept liability or provide compensation beyond these options if changes or cancellations are
required due to unforeseen circumstances beyond our control, which could not have been avoided even with
utmost care. If we cancel due to your non-compliance with booking conditions, or the change is minor, no
compensation or options will be available. Minor changes do not significantly impact your confirmed holiday
based on the information provided during booking. Children aged 2 and under are not eligible for
compensation.
Please note, we cannot be held liable for any damage, loss, expense, or costs arising from:

a) Information provided by you regarding your booking that we could not have reasonably foreseen, resulting
in a breach of our contract with you.
b) Any incidents not arising from our breach of contract or fault by us or our employees or suppliers.
Additionally, we cannot accept liability for business-related losses.

Insurance Requirements

Travelers must obtain adequate comprehensive travel and medical insurance for themselves and any
dependents or traveling companions throughout their trip. This insurance should cover medical expenses and
repatriation costs. Optional coverage may include cancellation or curtailment of the safari, emergency
evacuation expenses (flying doctors), and damage, theft, or loss of personal baggage, money, and goods.

Medical Conditions and Disabilities

If you or any member of your party has a medical condition or disability that may affect your holiday, please
inform us before confirming your booking. This allows us to advise you on the suitability of the chosen
arrangements. You must provide full details in writing at the time of booking. If we determine that we cannot
adequately accommodate specific needs, we reserve the right to decline the booking or cancel it if complete
information is not provided at the time of booking.

Travel Documents

Passports, Visas, and Vaccination Documents

Travelers are responsible for ensuring that passports and visas are valid for all countries visited. They must also
verify required vaccination documents for entry. Please check with Immigration Services or Embassies
regarding regulations before departure. Tanzania Specialist is not liable for any issues arising from a lack of
proper travel documents or related costs.

Additional Information

We will send all vouchers (if applicable) and domestic e-tickets between two weeks and three days before your
departure.

Carriers

Carriage by air and sea, whether international or domestic, is governed by the terms and conditions of the
respective carriers and applicable international conventions. Kingse safaris accepts no liability for
compensation related to cancellations, strikes, timetable changes, diversions, technical issues unrelated to
Kingse safaris, lost luggage, rescheduling costs, missed accommodations, or delays due to operational
decisions by the carrier, even if we arranged the ticket. However, we strive to ensure the booked holiday
proceeds as smoothly as possible.

Domestic air and sea transport is subject to schedule changes. Travelers will be notified promptly of any
modifications, and we will take necessary measures to keep the itinerary unaffected. Kingse safaris liability for
damages is limited to three times the travel sum. We are not liable if obligations are unfulfilled due to traveller
error, unavoidable circumstances, or actions of third parties not engaged by the organizer.

Domestic air travel in Tanzania is conducted by local carriers licensed and regulated by the Tanzania Civil
Aviation Authority (TCAA), ensuring compliance with International Civil Aviation Organization (ICAO) safety
standards. The inclusion of certain Tanzanian airlines on the European Union Air Safety List is due to regulatory
oversight limitations and does not indicate safety concerns or technical deficiencies of the airlines.

Risks

By participating in our travel products, you acknowledge the inherent risks associated with wilderness, health,
transport, and personal safety, which you voluntarily assume. Standards of hygiene, accommodation,
healthcare, public transport, and road conditions may differ from those in your home country. Risks may
include wild animal encounters, wildfires, extreme weather, rough terrains, endemic diseases (e.g., malaria),
public transportation safety, and theft.

Kingse Safaris will make reasonable efforts to provide guidance on weather conditions, safety considerations,
physical challenges, health formalities, local customs, and applicable laws in the areas visited.

You agree to take all reasonable measures to ensure your safety during the trip, including using safety
equipment (like seatbelts or helmets) and following posted warnings or instructions. Kingse safaris is not liable
for any harm resulting from your failure to adhere to safety recommendations or instructions from KS or
its third-party suppliers.

Limitations of Liability

Kingse Safaris (KS) is responsible for ensuring that your holiday is executed as described before departure and
that the services provided meet reasonable local standards. We cannot accept liability for services not
included in our contract, such as additional services offered by your hotel or suppliers that are not advertised
in our brochure.

Activities and services mentioned in our brochure that do not form part of your contract with KS are not our
responsibility. These activities, which we may suggest or help you book, are outside our control and do not
constitute part of your agreement with us. KS acts solely as a booking agent for these external activities. Your
contract for any such service will be with the respective supplier or operator. KS is not liable for any acts or
omissions by these third parties or their employees. If we are found liable concerning these services, our
liability is limited to the cost of the specific activity. We do not limit or exclude liability for death or personal
injury resulting from negligence.

We would like to remind you that the infrastructure in developing countries may not match the standards of
your home country. Some accommodations may occasionally experience power cuts or water shortages.
Kingse Safaris’ liability for damages you suffer is limited to three times the total travel sum. We are not liable
for any failure to fulfill an obligation if it results from your actions, unavoidable and extraordinary
circumstances, or a third party not engaged by us in delivering travel services.

Kingse Safaris is not liable for any breach of obligation if it results from your actions as a traveller, unavoidable
and extraordinary circumstances, actions of a third party not engaged by us in providing travel services, or if
the non-conformity could not have been foreseen or prevented.

Problems During Your Trip

If you encounter any issues during your holiday, please promptly notify the relevant service provider, such as
the camp/hotel manager or activity organizer, who will do their best to address and resolve the matter. We will
also provide you with the contact details of your Customer Satisfaction Agent at the destination to assist you.
They can offer information about medical services, local authorities, consular assistance, and help you with
practical matters, such as finding alternative travel arrangements if necessary.

If the problem cannot be resolved on-site, it is essential that you provide Kingse Safaris with comprehensive
written details within 28 days of your return to your home country. Failure to follow this procedure may result
in us being unable to accept liability (if there would be any liability), as it deprives us of the opportunity to
investigate and rectify the issue.

Local Laws and Regulations

During your trip, you must adhere to all applicable local laws and the regulations of tours, carriers, and
accommodations. Failure to do so may result in your trip being cancelled with no refund owing from KS.

Contract

Your contract is with Kingse Safaris. Please pay attention to the terms and conditions outlined above, which
cover all brochures, correspondence, and bookings made with us. Any contract with Kingse Safaris is subject to
these terms and conditions, from which no person other than a Director of Kingse Safaris has the authority to
deviate. By making a booking, the lead client and all parties in the group accept these terms and conditions
before the contract comes into existence. By booking and commencing your trip with Kingse Safaris you are
bound by all terms and condition listed above and below.

When you book a travel package, a package travel agreement is formed between you and Kingse Safaris. The
booking confirmation serves as the contract between you and Kingse Safaris and is proof of the existence and
content of the package travel agreement. Please note that minors are not permitted to make bookings.
